1. Acceptance of Terms

Welcome to PetPixel. These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the PetPixel website, mobile application, and AI-powered pet transformation service (collectively, the "Service"). The Service is operated by PetPixel, Inc. ("PetPixel", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service. Your continued use of the Service constitutes acceptance of these Terms and any future amendments.

These Terms apply to all users, including visitors, registered users, and any other users who access the Service.

2. Eligibility and Account Registration

2.1 Age Requirements

You must be at least 13 years old (or 16 years old if you are located in the European Economic Area) to use our Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have your parent or legal guardian's permission to use the Service.

2.2 Account Creation

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

2.3 Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Prolonged inactivity
• Non-payment or chargebacks

3. Description of Service

PetPixel is an AI-powered pet transformation service that allows users to upload photos of their pets and generate creative, AI-transformed images based on text prompts. The Service includes:

• AI-powered image transformation using multiple providers (Fal.ai, Replicate, Kie.ai)
• Credit-based payment system for transformations
• Image storage and gallery management
• Referral program with bonus credits
• User dashboard and profile management

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

4. Credits and Payment Terms

4.1 Credit System

The Service operates on a credit-based system. Each image transformation consumes one (1) credit from your account. Credits are purchased through our payment processor, Polar.

4.2 Pricing and Packages

Credit packages and pricing are displayed on our Pricing page. We reserve the right to change our pricing at any time. Price changes will not affect credits already purchased.

4.3 Payment Processing

All payments are processed securely through Polar, our third-party payment processor. By making a purchase, you agree to Polar's terms of service and privacy policy. We do not store your full payment card details.

4.4 Credit Expiration

Credits do not expire and remain in your account indefinitely. However, we reserve the right to implement expiration policies with reasonable notice in the future.

4.5 No Refunds

All credit purchases are final and non-refundable, except as required by law or as stated in our refund policy below. Once credits are used to generate images, they cannot be refunded.

4.6 Refund Policy

We offer a 7-day money-back guarantee for unused credits only. To request a refund:

• The request must be made within 7 days of purchase
• The credits must be unused (no transformations performed)
• Contact our support team at support@petpixel.com with your order details

Refunds will be processed to the original payment method within 5-10 business days.

4.7 Taxes

You are responsible for any applicable taxes, including sales tax, VAT, or other local taxes based on your location. Prices displayed may not include taxes.

5. User Conduct and Acceptable Use

You agree to use the Service in compliance with all applicable laws and regulations. You agree NOT to:

• Upload images that are illegal, obscene, defamatory, harassing, or otherwise objectionable
• Upload images containing minors without proper consent
• Upload images of people without their consent (Service is intended for pets only)
• Violate any intellectual property rights or privacy rights of others
• Use the Service to generate harmful, offensive, or inappropriate content
• Attempt to reverse engineer, decompile, or hack the Service
• Use automated tools (bots, scrapers) to access the Service without permission
• Share, sell, or transfer your account or credits to another person
• Abuse the referral program or create fake accounts for bonus credits
• Overload or interfere with the proper functioning of the Service
• Use the Service for commercial purposes without our written permission
• Impersonate any person or entity or misrepresent your affiliation

Violation of these terms may result in immediate account suspension or termination and forfeiture of credits.

6. Content and Intellectual Property

6.1 Your Content

You retain all ownership rights to the original images you upload ("Your Content"). By uploading images to the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, process, and display your images as necessary to provide the Service
• Use AI providers to generate transformed images based on your images and prompts
• Create backups and ensure service availability

We will not use your images for marketing, training AI models, or any other purpose without your explicit consent. This license terminates when you delete your content or account.

6.2 AI-Generated Content

Images generated by our AI Service ("Generated Content") are created based on your prompts and original images. You own the Generated Content, subject to the following:

• Generated images are for your personal, non-commercial use unless otherwise agreed
• You are responsible for ensuring Generated Content complies with applicable laws
• We do not claim ownership of Generated Content
• AI-generated images may not be eligible for copyright protection under current laws

6.3 PetPixel Intellectual Property

The Service, including its design, features, code, logos, and content (excluding user-generated content), is owned by PetPixel and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our intellectual property
• Use our trademarks or branding without permission
• Create derivative works based on the Service

6.4 Feedback and Suggestions

Any feedback, suggestions, or ideas you provide to us regarding the Service become our property, and we may use them without any obligation or compensation to you.

7. AI Service Disclaimers

7.1 Quality and Results

AI-generated images are created using machine learning algorithms. We do not guarantee:

• Specific quality, accuracy, or aesthetic results
• That Generated Content will match your expectations
• That transformations will be free from errors or artifacts
• Availability of specific AI providers (we use multiple providers with automatic fallback)

Credits are consumed when a transformation is initiated, regardless of whether you are satisfied with the results. We recommend reviewing sample images in our gallery before purchasing.

7.2 Service Availability

While we strive for high availability, the Service may be subject to:

• Scheduled or emergency maintenance
• Third-party AI provider outages or limitations
• Technical issues or downtime
• Rate limiting during high-demand periods

We will make reasonable efforts to restore service promptly but cannot guarantee uninterrupted access.

7.3 AI Limitations

AI technology has inherent limitations and may:

• Produce unexpected or unwanted results
• Fail to accurately interpret complex prompts
• Generate images with artifacts, distortions, or errors
• Produce content that requires multiple attempts to achieve desired results

8. Referral Program

PetPixel offers a referral program where users can earn bonus credits by referring new users. The terms of the referral program:

• You receive bonus credits when someone signs up using your unique referral code
• The new user may also receive bonus credits upon sign-up
• Referral bonuses are subject to change and may be modified or discontinued at any time
• Fraudulent referrals (fake accounts, self-referrals) will result in forfeiture of bonuses and potential account termination
• We reserve the right to audit and reverse fraudulent referral credits
• Referral codes are for personal use only and may not be used for commercial promotion without permission

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• We collect personal information, images, and usage data to provide the Service
• We use third-party AI providers to process your images
• We implement security measures to protect your data
• You have rights regarding your personal information (access, correction, deletion)

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETPIXEL SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT
• STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE
• QUALITY, ACCURACY, OR SUITABILITY OF AI-GENERATED IMAGES
• ANY OTHER MATTER RELATING TO THE SERVICE

IN NO EVENT SHALL PETPIXEL'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE LAST SIX (6) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE
• THAT THE SERVICE WILL BE SECURE, UNINTERRUPTED, OR ERROR-FREE
• THAT DEFECTS WILL BE CORRECTED
• QUALITY OF ANY PRODUCTS, SERVICES, OR CONTENT OBTAINED THROUGH THE SERVICE

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

12. Indemnification

You agree to indemnify, defend, and hold harmless PetPixel, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Content you upload or create using the Service
• Any claim that your Content caused damage to a third party

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before filing a claim, you agree to contact us at hello@petpixel.app to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

13.2 Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration conducted by a recognized arbitration organization, rather than in court. The arbitration will be conducted in accordance with the organization's rules.

13.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

13.4 Exceptions

Either party may seek injunctive or equitable relief in court for intellectual property infringement or unauthorized access to the Service.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State/Country], without regard to its conflict of law provisions.

For any disputes not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the courts located in [Your Jurisdiction].

• Your unused credits will be forfeited (no refunds for voluntary termination)
• Your images and data will be deleted within 30 days
• Transaction records will be retained for legal and accounting purposes

We may terminate or suspend your account immediately, without prior notice, if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

17. Third-Party Services and Links

The Service may integrate with or contain links to third-party services, including:

• Polar: Payment processing
• Supabase: Authentication and data storage
• Fal.ai, Replicate, Kie.ai: AI image generation
• Vercel: Analytics and hosting

We are not responsible for the content, terms, or practices of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and PetPixel regarding the Service and supersede all prior agreements and understandings.

20. Assignment

You may not assign or transfer these Terms or your account to any third party without our prior written consent. We may assign these Terms to any affiliate or successor without restriction.

21. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of PetPixel.
